FAIRO EVENT „Invoice with reward”

(event code E2022 / 08) [X]

FAIRO GmbH, Am Stadtpark 9, 1030 Vienna, registered with the Commercial Court Vienna (Handelsgericht Wien) under FN 552682v, (hereinafter “FAIRO”) will grant rewards to all Registered Users who received invitation for Participating in this reward program (hereinafter - Invitation), are issuing invoices through the App and which are paid to a bank account connected to the App between 29.11.2022 and 31.1.2023 (Reward Period) subject to the terms and conditions as detailed below:

Terms and Conditions of Rewards:

  • The Rewards will be granted during the months December 2022, January 2023 (each a “Reward  Month”);

 

  • Each Invoice that is (i) created and sent through the App by a Registered User, who received Invitation, within a Reward Months and (ii) paid within a Reward Months to the account of the Registered User mentioned in the invoice and connected to the App within the Reward Months will participate automatically (each a “Participating Invoice”);

 

  • The issuer of each Participating Invoice will get from Fairo  based on the subscription level the following rewards: 
  • every Registered User will receive 1% of the respective Participating Invoice’s net amount (i.e. amount without VAT or any other tax, if any). The maximum Reward per each participating Invoice is 50 lei.     
  • A  Reward is paid only for the first five Participating Invoices issued during the respective Competition Months by a Registered User;
  • Invitation is  an email with invitation to participate in this Reward Program received directly from FAIRO and expressly referring to the offer to receive a Reward making use of the event code E2022/08.

  • Each Reward will be disbursed in the bank account connected to the App within 28 days from the end of the Competition Period in which the Participating Invoice was paid.

     

All further liability out of or in connection with the granting of the Rewards shall be excluded. There is no recourse to any courts. This event shall be governed by the laws of Austria excluding its conflict of law provisions and any dispute arising in connection with this event shall be decided by the courts competent for the first district (Innere Stadt) of Vienna, Austria.

Personal data processing within the scope of this event

FAIRO will process the personal data of its customers under article 6 paragraph 1 letter f) of the General data protection regulation (EU) 2016/679 (hereinafter the “GDPR”) for the purpose of realisation of its legitimate interest in the support the awareness of its brand and in the support of the sale of its services and furthermore for the purpose of establishing, enforcement and defence of legal claims and defence against legal claims.

Information according to the article 13 GDPR

Identity and contact details of the personal data controller: FAIRO GmbH, Am Stadtpark 9, 1030 Vienna, registered with the Commercial Court Vienna (Handelsgericht Wien) under FN 552682v, e-mail address: dataprotection@fairo.ro.

Purpose of personal data processing: support the awareness of the brand, support of the sale of the services, establishing, enforcement and defence of legal claims and defence against legal claims

Legal basis of personal data processing: realisation of legitimate interest under article 6 paragraph 1 letter f) GDPR.

Categories of personal data being processed: identification and contact details, bank account number, information about the use of the FAIRO application and issuance of invoices

Categories of recipients: none 

Intention on the transfer of personal data to third countries or international organisations: the controller does not intend to transfer the personal data to third countries nor to international organisations.

Retention period of personal data of data subjects: until the end of the competition and three years thereafter.

Rights of data subjects: the data subject shall in particular have the right to request from the controller access to personal data relating to the data subject, the right to rectify or delete them or to restrict processing, and to object to the processing as well as the right to data portability. The data subject also has the right to file a complaint with the competent local supervisory authority and to address to the competent courts of law. Data subjects can also address the Austrian Data Protection Authority, Barichgasse 40-42, 1030 Vienna, Austria, www.dsb.gv.at. 

The provision of personal data is not a legal or contractual requirement or a requirement to conclude a contract. The provision of personal data is voluntary. If the data subject does not provide her/his personal data, she/he will not be able to receive the Bonus in this event. 

Personal data is not subject to automated decision-making, including profiling.

FAIRO EVENT „Factură cu recompensă”

FAIRO GmbH, Am Stadtpark 9, 1030 Vienna, înregistrat la Commercial Court Vienna (Handelsgericht Wien) sub numărul FN 552682v, (denumit în continuare “FAIRO”), FAIRO GmbH, Am Stadtpark 9, 1030 Viena, înregistrată la Tribunalul Comercial din Viena (Handelsgericht Wien) sub FN 552682v, (denumită în continuare „FAIRO”) va acorda recompense tuturor Utilizatorilor înregistrați care au primit o invitație de a participa în aceasta campanie (denumită în continuare - Invitație), emit facturi prin intermediul aplicației și care sunt plătite în contul bancar conectat la aplicație, între 29.11.2022 și 31.1.2023 (Perioada de recompensă) conform termenilor și condițiilor detaliate mai jos:

Termeni și condiții pentru promotie:

  • Recompensele vor fi acordate în lunile Decembrie 2022 și Ianuarie 2023 (fiecare o „Lună a recompenselor”);
  • Fiecare Factură care este (i) creată și trimisă prin Aplicație de către un Utilizator care a fost invitat într-o Lună de Recompensă și (ii) plătită într-o Lună de Recompensă în contul Utilizatorului menționat în factură și conectată la Aplicație în Perioada de Recompensă va participa automat (fiecare o „Factură Participantă”);
  • Emitentul fiecărei Facturi Participante va primi de la Fairo, pe baza nivelului de abonament, următoarele recompense:
  • fiecare client va primi 1% din suma netă a respectivei facturi participante (adică suma fără TVA sau orice altă taxă, dacă există). Recompensa maximă pentru fiecare factură participantă este de 50 lei. 
  • O recompensă se plătește numai pentru primele cinci facturi participante emise în cursul respectivei luni a competiției de către un utilizator înregistrat;
  • Invitația este un email trimis de către Fairo pentru a participa în aceasta campanie si se refera in mod strict numai la campania cu numărul de cod E2022/08
  • Fiecare recompensă va fi plătită în contul bancar conectat la Aplicație în termen de 28 de zile de la sfârșitul Lunii Concursului în care a fost plătită Factura de Participare. 

 

Promoția va fi guvernată de legile din Austria, cu excepția prevederilor legale conflictuale, iar orice alte conflicte legate de această promoție vor fi soluționate de către instanțele competente din prima instanță (Innere Stadt) din Vienna, Austria.

Procesarea datelor personale în vederea acestei promoții

FAIRO va procesa datele clienților săi sub incidența articolului 6, paragraful 1, litera f). din Regulamentul General Privind Protecția Datelor (EU) 2016/679 (denumit în continuare "GDPR"), în vederea urmăririi intereselor sale legitime pentru susținerea awareness-ului acestui brand și pentru susținerea vânzării serviciilor sale, dar și stabilirea, implementarea și apărarea cerințele legale, precum și apărarea împotriva oricăror pretenții legale.

Informarea în conformitate cu articolul 13 GDPR

Identitatea și datele de contact ale operatorului de date personale: FAIRO GmbH, Am Stadtpark 9, 1030 Vienna, înregistrat la Commercial Court Vienna (Handelsgericht Wien) sub numărul FN 552682v, având adresa de e-mail: dataprotection@fairo.ro.

Scopul prelucrării datelor: susținerea awareness-ului acestui brand și susținerea vânzării serviciilor sale, dar și stabilirea, implementarea și apărarea cerințele legale, precum și apărarea împotriva oricăror pretenții legale.

Baza legală a procesării datelor personale: realizarea intereselor legitime sub articolului 6, paragraful 1, litera f). din GDPR.

Categoriile de datele personale procesate: date de indentificare și de contact, numărul contului bancar (IBAN), informații despre utilizarea aplicației FAIRO și despre emiterea facturilor. 

Categoriile de destinatari: nu există.

Intenția de transfer a datelor personale în țări terțe sau organizații internaționale: operatorul de date personale nu are intenția de a transfera datele personale către țări terțe sau organizații internaționale.

Perioada de reținere a datelor personale ale subiecților: până la finalul competiției și 3 ani după aceasta.

Drepturile subiecților: aceștia vor avea dreptul să solicite personal de la operatorul de date personale accesul la datele personale legate de persoana acestora, dreptul de a rectifica sau șterge aceste date sau de a restricționa procesarea lor, precum și dreptul de a se opune procesării și dreptul de portare a datelor. Subiecții au dreptul și să depună o plângere la autoritatea de supraveghere locală competentă și să se adreseze instanțelor competente. Subiecții se pot adresa și Autorității de Protecție a Datelor din Austria, Barichgasse 40-42, 1030 Viena, Austria, www.dsb.gv.at.

Furnizarea datelor personale nu este o cerință legală sau contractuală sau o cerință pentru încheierea unui contract. Furnizarea datelor personale este voluntară. Dacă subiectul nu dorește să-și furnizeze datele personale, acesta nu va putea să primească Bonusul din promoție. 

Datele personale nu fac subiectul deciziilor automatizate, incluzând profilarea.
